By purchasing from us, you agree to provide accurate billing information and authorize us and our third-party payment processors to charge your selected payment method for the total amount shown at checkout.

SUBSCRIPTIONS, MEMBERSHIPS, RENEWALS, AND CANCELLATIONS

Some offerings may be sold as recurring memberships, subscriptions, payment plans, or other recurring billing arrangements.

By purchasing a subscription, membership, payment plan, or recurring offer, you authorize us and our third-party payment processors to charge your payment method on a recurring basis according to the billing terms presented at checkout.

Unless otherwise stated at checkout, subscriptions and memberships automatically renew until cancelled. You are responsible for cancelling before your next billing date if you do not wish to continue.

Cancellation stops future billing but does not automatically entitle you to a refund for amounts already paid. Unless otherwise stated in writing, we do not provide partial refunds, prorated refunds, credits, or retroactive cancellations for subscriptions, memberships, payment plans, or recurring offers.

If you cancel a membership or subscription, your access may continue until the end of the current paid billing period, unless otherwise stated at checkout or unless your access is terminated due to violation of these Terms.

We may change subscription or membership pricing, features, access levels, or billing terms from time to time. Where required, we will provide notice before changes apply to your existing subscription or membership.

You agree to keep your payment method current. If your payment method fails, we may attempt to process payment again, suspend access, cancel your membership or subscription, or revoke access to the relevant materials.

REFUND POLICY FOR DIGITAL PRODUCTS, PROGRAMS, MEMBERSHIPS, AND DOWNLOADABLE CONTENT

Due to the nature of digital materials, all sales are final unless otherwise expressly stated in writing at the time of purchase.

Changing your mind, purchasing in error, lack of results, misunderstanding the product description, failure to use the product, dissatisfaction with the format, or deciding the product is not a fit does not entitle you to a refund.

CHARGEBACKS AND PAYMENT DISPUTES

By purchasing from us, you agree not to initiate a chargeback, payment dispute, reversal, or similar claim without first contacting us at hello (at) soulmotion.ai to attempt resolution.

If you initiate a chargeback, payment dispute, or reversal, we reserve the right to immediately revoke access to all purchased materials, suspend or terminate your account, restrict future purchases, and pursue collection of any outstanding amounts.

You remain responsible for any fees, costs, payment processor fees, collection expenses, or other losses incurred as a result of an improper chargeback, payment dispute, or reversal.

MARKETING COMMUNICATIONS

By purchasing, creating an account, downloading a resource, joining a waitlist, signing up for a free or paid offering, or otherwise providing your email address, you agree to receive communications from us. These may include product updates, helpful tips, recommendations, educational content, promotional offers, account notices, and information about other products or services we may offer.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, PLATFORM, PRODUCTS, PROGRAMS, MEMBERSHIPS, SERVICES, MATERIALS, CONTENT, DOWNLOADS, REPORTS, AI-ENABLED TOOLS, OR AI-GENERATED OUTPUTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

2. Your violation of these Terms.

3. Your violation of any law, regulation, or third-party right.

4. Your submissions, user content, testimonials, comments, prompts, inputs, data, or materials.

5. Your unauthorized use, reproduction, distribution, or exploitation of our intellectual property.

6. Your chargeback, payment dispute, failed payment, or unpaid amount.

7. Your conduct in any community, group, member space, event, or interactive feature.

TERMINATION

We may suspend, restrict, or terminate your access to the website, platform, products, programs, memberships, services, materials, community spaces, or account at any time, with or without notice, if we believe you have violated these Terms, failed to pay, misused our materials, created risk for us or other users, or engaged in conduct we deem inappropriate, unlawful, harmful, or disruptive.

Termination does not relieve you of payment obligations incurred before termination. Sections relating to intellectual property, payment obligations, refund policy, chargebacks, disclaimers, limitations of liability, indemnification, dispute resolution, and other provisions that by their nature should survive will survive termination.

You and we waive the right to a jury trial and the right to have disputes resolved in court, except for claims that may properly be brought in small claims court or where arbitration is not permitted by applicable law.

If any part of this arbitration or class action waiver section is found unenforceable, the remaining portions shall remain in effect to the maximum extent permitted by law.

ATTORNEYS’ FEES AND COSTS

To the extent permitted by law, the prevailing party in any action, arbitration, or proceeding arising out of or relating to these Terms may be entitled to recover reasonable attorneys’ fees and costs.

NO THIRD-PARTY BENEFICIARIES

FORCE MAJEURE

We will not be liable or responsible for any failure or delay in performance caused by events or circumstances beyond our reasonable control, including acts of God, natural disasters, fire, flood, earthquake, pandemic, epidemic, war, terrorism, civil unrest, labor disputes, government action, power outages, internet outages, hosting failures, platform failures, payment processor issues, supply shortages, third-party service failures, cyberattacks, or other events beyond our reasonable control.
